1.              THESE TERMS

These are the terms and conditions on which we supply our products and they govern your use of our website. By placing an order with us you are agreeing to accept our Terms and Conditions for the purchase of our products that appear on our website. Our website can be found www.Sensorysmart.store.

1.1            Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

2.              INFORMATION ABOUT US AND HOW TO CONTACT US

2.1            We are Sensory Smart, a company registered in England and Wales. Our company registration number is 15009486 and our registered office is at Concorde House, Union Drive, Sutton Coldfield, West Midlands, B73 5TE.

2.3            If we have to contact you, we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.

2.4            "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.

3.              OUR CONTRACT WITH YOU

3.1         Nothing provided by us including, but not limited to, sales and marketing literature, price lists and other documents constitutes a contractual offer capable of acceptance.  Your order constitutes a contractual offer that we may, at our discretion, accept.  

3.2 Our acceptance of your order will take place when you place an order on our website www.Sensorysmart.store and we email you to accept it, at which point a contract will come into existence between you and us.

3.2            If we cannot accept your order. If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

3.3            Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

4.              OUR PRODUCTS

4.1            Products may vary slightly from their pictures. The images of the Products on our website are for illustrative purposes only.

4.2            Product packaging may vary. The packaging of the product may vary from that shown on images on our website.

5.              OUR RIGHTS TO MAKE CHANGES

Minor changes to the Products. Our supplier may change the Product:

(a)         to reflect changes in relevant laws and regulatory requirements from our supplier and

(b)         to implement minor technical adjustments and improvements

6.              PRICE AND PAYMENT

6.1       The price of the Product will be the price indicated on the order pages when you placed your order. All prices stated are in Great British Pounds and are exclusive of VAT

6.2  The prices may change at any time but these changes will not affect any orders that we have already accepted.

6.3 Our prices exclude the cost of delivery.  Delivery costs will be added on to the final sum due[KJ1] .

6.4 All payments for Products must be made in advance before we can despatch the Products to you.

6.5       Our preferred method of payment is via Paypal however we do accept payments via credit or debit card or online BACS transfer.

7.         COMPLIMENTARY GIFT CARD

There is an option to provide you with a complimentary gift card with your order which can be customised. This is restricted to one gift card per order. The cards are designed by us. Just email help@Sensorysmart.store with your special message at the time of ordering and we will be happy to add it to your parcel.

8.       Our Liability

8.1      We only supply Products for domestic and private use.  We make no warranty or representation that the Products are fit for commercial, business or industrial use of any kind (including resale). By making your order, you agree that you will not use the Products for such purposes.  We will not be liable to you for any loss of profit, loss of business, interruption to business or for any loss of business opportunity.

8.2      Nothing in these terms and conditions seeks to exclude or limit our liability for death or personal injury caused by our negligence (including that of our employees, agents or sub-contractors); or for fraud or fraudulent misrepresentation.

8.3      Nothing in these terms and conditions seeks to exclude or limit your legal rights as a consumer.  For more details of your legal rights, please refer to your local Citizens Advice Bureau or Trading Standards Office.

 

9.       Events Outside of Our Control (Force Majeure)

9.1      We will not be liable for any failure or delay in performing our obligations where that fail                                                                  ure or delay results from any cause that is beyond our reasonable control.  Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond Our reasonable control.

9.2      If any event described under this clause occurs that is likely to adversely affect our performance of any of our obligations under these terms and conditions:

9.2.1   We will inform you as soon as is reasonably possible;

9.2.2   Our obligations under these terms and conditions will be suspended and any time limits that we are bound by will be extended accordingly;

9.2.3   We will inform you when the event outside of our control is over and provide details of any new dates, times or availability of Products necessary;

9.2.4   If the event outside of our control continues for more than 30 calendar days we will cancel the contract and inform you of the cancellation.  Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible;

10.      How We Use Your Personal Information (Data Protection)

We will only use your personal information as set out in Privacy Notice [insert link][KJ2] 

11.         MISCELLANEOUS

11.1       We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.

11.2       Nobody else has any rights under this contract. This contract is between you and us.

11.3       If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.4       Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.

11.5       Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
